Terms of Use

1. Acceptance of Terms

By downloading, installing, or using the GiveIt mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App. We reserve the right to modify these Terms at any time, and your continued use constitutes acceptance of the modified Terms.

2. Description of Service

GiveIt is a free mobile application that connects local communities to facilitate the donation and exchange of items. The App allows users to:

  • Post items they wish to donate

  • Browse and request items posted by other users

  • Communicate with other users through integrated messaging

  • Leave reviews and ratings for other users

  • Build a trusted community through verified donations

3. Eligibility and Account Registration

  • You must be at least 17 years old to use GiveIt

  • You must create an account with a valid email address

  • You must verify your email address before using the App

  • You are responsible for maintaining the confidentiality of your account credentials

  • You are responsible for all activities that occur under your account

  • You must provide accurate and complete information when creating your account

  • One person or entity may maintain only one account

4. User Conduct and Responsibilities

You agree to:

  • Use the App only for lawful purposes

  • Treat all users with respect and courtesy

  • Provide accurate information about items you post

  • Complete transactions you commit to (requesting or donating items)

  • Communicate honestly and respectfully with other users

  • Report any suspicious or inappropriate behavior

You agree NOT to:

  • Post false, misleading, or fraudulent information

  • Post items that are illegal, stolen, or dangerous

  • Harass, threaten, or abuse other users

  • Use the App for commercial purposes or resale

  • Spam or send unsolicited messages

  • Attempt to circumvent the App's security or moderation systems

  • Impersonate another person or entity

  • Use automated systems to access the App

5. User Content

  • You retain ownership of content you post (items, photos, messages)

  • By posting content, you grant GiveIt a license to display, store, and distribute that content within the App

  • You are solely responsible for the content you post

  • We reserve the right to remove any content that violates these Terms

  • Content is automatically moderated for inappropriate language and spam

  • We do not guarantee the accuracy, quality, or safety of user-generated content

6. Location Services

  • Location services are optional but enhance your experience

  • We use your location to show items near you and calculate distances

  • Location data is stored as geohash codes, not exact coordinates

  • You can revoke location permission at any time in your device settings

  • Using the App without location access will show country-wide items instead

7. Transactions and Exchanges

  • GiveIt facilitates connections between users but is not a party to any transaction

  • All items are donated free of charge - no money should exchange hands

  • Users are responsible for arranging pickup or delivery of items

  • We recommend meeting in public places and following safety guidelines

  • GiveIt is not responsible for the condition, quality, or safety of items

  • GiveIt is not responsible for any disputes between users

  • Users exchange items at their own risk

8. Reviews and Ratings

  • Users may leave reviews and ratings after completing a donation

  • Reviews must be honest and based on actual experience

  • Reviews cannot contain inappropriate content, personal attacks, or false information

  • We reserve the right to remove reviews that violate these Terms

  • Reviews are public and visible to all users

9. Intellectual Property

  • The GiveIt App, including its design, features, and functionality, is owned by us

  • Our trademarks, logos, and brand names are our property

  • You may not copy, modify, or create derivative works of the App

  • You may not reverse engineer or attempt to extract source code

  • User-generated content remains the property of the user who created it

10. Prohibited Items

You may NOT post:

  • Illegal items or items that violate laws

  • Stolen property

  • Weapons, firearms, or dangerous items

  • Drugs, alcohol, or controlled substances

  • Items that infringe on intellectual property rights

  • Live animals

  • Perishable food items

  • Items that are broken beyond safe use

  • Any item that could cause harm to recipients

11. Account Termination

We reserve the right to:

  • Suspend or terminate your account for violations of these Terms

  • Remove content that violates these Terms

  • Ban users who engage in harmful or illegal activities

  • Delete accounts that are inactive for extended periods

You may delete your account at any time through the App settings. Account deletion permanently removes all your data, including items, messages, and reviews.

12. Disclaimers

  • The App is provided "as is" without warranties of any kind

  • We do not guarantee the App will be error-free or uninterrupted

  • We do not guarantee the availability of specific items

  • We do not guarantee the accuracy of user-provided information

  • We are not responsible for user interactions or transactions

  • We are not responsible for any loss or damage resulting from use of the App

13. Limitation of Liability

To the maximum extent permitted by law:

  • GiveIt shall not be liable for any indirect, incidental, or consequential damages

  • Our total liability shall not exceed the amount you paid to use the App (which is $0, as the App is free)

  • We are not liable for any harm resulting from user interactions or item exchanges

  • We are not liable for any loss of data or content

14. Indemnification

You agree to indemnify and hold GiveIt harmless from any claims, damages, or expenses arising from:

  • Your use of the App

  • Your violation of these Terms

  • Your violation of any rights of another user or third party

  • Content you post or share through the App

15. Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

16. Safety Guidelines

  • Meet in public places for item exchanges

  • Bring a friend if meeting someone for the first time

  • Trust your instincts - if something feels wrong, leave

  • Report suspicious behavior immediately

  • Do not share personal information beyond what's necessary

  • Follow all local laws and regulations

17. Modifications to the Service

We reserve the right to:

  • Modify, suspend, or discontinue any part of the App at any time

  • Add or remove features

  • Change how the App works

  • Update the App with new versions

We will notify users of significant changes when possible.

18. Dispute Resolution

  • Users are encouraged to resolve disputes directly

  • These Terms are governed by the laws of Romania

  • Any disputes shall be resolved in the courts of Romania

19. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Posting the updated Terms on this page

  • Updating the "Last Updated" date

  • Sending a notification through the App (for significant changes)

Your continued use of the App after changes become effective constitutes acceptance of the updated Terms.
